Minna magistrate court remands youngster over alledged rape of JSS 2 student

A 25 year old Mohammed Habibu has been remanded in correctional centre for forcefully having sexual intercourse with a JSS 2 student.

He was remanded on order of tje Chief Magistrate Court No 2.

Mohammed was arraigned on two count charges which bodered criminal trespass, unlawful sexual intercourse with a child and impregnating a female student.

The two count charges, according to the Police prosecutor, Sgt. Bello Mohammed contravened Section 345 of the penal code law and section (18) (20) and section 25(3) of the Nigerian Child Right Law of Niger State, 2010.

The Prosecutor told the court that “on the 17th of June 2020, one Lawal Yahaya of Sabon gari area of Maikunkele in Bosso Local goverment area of Niger State reported at Area Commander’s office Minna, to report the incident.

“Some times in the month of February, 2020, one Mohammed Habibu, aged 25 of Tudun Wada area of Kagara area of Rafi Local Government area of Niger State came into his house in his absence and met his sister, Mardiya Isah, and you lured his younger sister Amina Yahaya aged 15, of Abdullahi Dada Secondary School in Maikunkele in JSS 2 class and you forcefully had sexual intercourse with her on four different occasions resulting to her being put in to family way.

When the charges were read to him by the presiding chief Magistrate, Hajiya Hauwa Baba Yusuf, he pleaded not guilty to the charges.

The prosecutor, Sgt Bello Mohammed requested the court to remand him in correctional custody even as heobjected to his bail on the ground that the cases of such nature is on the increase in recent times and is not balable.

“My Lord I objected to the bail of the accused on the ground that the case of this nature is not ordinarily bailable and there is likelyhood of committing similar offence.”

His defense counsel, Barrister Mohammed Barau Shehu in his oral application to the court, requested for the bail of the accused stating that with his plea of not guilty to the charge, he is presumed innocent until proved.

The Presiding Chief Magistrate while ruling on the oral application of the defense counsel, averred that the counsel failed to cite any section or legal authority to convince the court and she ordered for his remand in correctional custody and adjougned the case to 20th of July, 2020 for further mention.
