Three accused arraigned for culpable homicide in Niger

Operatives of the homicide squad of the Niger State Police command Thursday, arraigned three persons, among them, two brothers before a Chief Magistrate Court in Minna, for alleged culpable homicide.

Bashir Ibrahim, 25 years old, Aliyu Ibrahim 22 years old, and Suleiman Mahmud all residents of Tudun Fulani area, in the outskirts of Minna the Niger State capital.

They were arraigned on a three count charge which border on criminal conspiracy, culpable homicide, and armed robbery.

According to the Police Prosecutor, Inspector Aliyu Yakubu Kuta, the three count charge contravened Section, 97 (22) and 298 of the penal code law.

Hajiya Hauwa Kulu Isah, the presiding Chief Magistrate did not take their plea on the ground that her court lack the jurisdiction to hear the case in view of the capital nature of the charge of culpable homicide preffered against them by the police punishable under section 221 of the penal code which attract death penalty if convicted.

She then ordered for their remand in the Minna correctional facility pending the out come of the legal advice from the Office of the Director of Public Prosecution (DPP), in the Ministry of Justice.
She then adjourned the case to July 19, 2022 for further mention.

She however asked the police to hasten up investigation and forward the case file to the office of the Director of Public Prosecution (DPP) in the Ministry of Justice for legal advice.

According to tihe Police First Information (FIR), report made available in court and obtained by our reporter, one Abba Shehu of Fadikpe area in Minna had reported at the Bosso Divisional Police Command that on the April, 12th 2022, “at about 1500 hrs, on the same date, three of the accused persons residents of Tudun Fulani Tsauni area of Bosso criminaly conspired among themselves while armed with knives lured his elder brother Hassan Shehu Tundun Fulani Tsauni area of Bosso in Minna, and stabbed him on his chest with a sharp Knife as a result of which he sustained deep injury and bled to death on the spot after which you carted away with the deceased vehicle Peugeot. 206 red ln colour, his money the sum of N3,5000.

“Also you took away two of his cellphones, iPhone and Techno.

“At this point, Police detective from the Homicide squad of the State Criminal Investigation Department (SCID), swung into action and arrested you Bashir Ibrahim, Aliyu Ibrahim and Suleiman Mahmud in connection with the case. During Police investigation, you all confessed to have committed the above offence.”
