Dismissed police remanded in prison for impregnating own daughter in Niger

The Police Authority in Minna, the Niger State Capital, has re-arraigned a dismissed inspector of the police Gbenga Fajuyi before the Chief Magistrate Court in Angwandaji.

CAPITAL POST reports that the dismissed Inspector, earlier charged to Minna Chief Magistrate court No. 2 for allegedly impgrenating his 17 years old biological daughter and killed the baby and buried her in a shallow grave.

He was remanded in correctional Centre on the order of the Chief Magistrate Nasir Mua’azu, and directed the police to forward his case file to the ministry of Justice for legal opinion.

However, the Director Public Prosecution (DPP), in the state Ministry of Justice Barrister Moses Chiroma, has exonerated the dismissed Inspector Gbenga Fajuyi and that his wife and his 17 years old daughter should be prosecuted for concealment of information.

Based on the legal opinion from the office of the DPP, the Chief Magistrate Nasir Mu’azu, discharged him and he was immediately whisked away by the operatives of police on court duty led by Mallam Ahmed Saidu Kongoma ASP.

He was re-arraigned on three count charge which bothered on unlawful sexual intercourse, incest impregnating a female student and criminal intimidation.

According to the police first information report (FIR) made available in court, and a copy in possession of CAPITAL POST, the offences were punishable under section 18 (2) of the Child right law of Niger State 2010, section 390, 25(3) and 397(b) of the penal code law.

The charges read in part: “That on 6th July, 2020 at about 1200 hrs, the chief Magistrate court No. 2 referred a case for investigation, that some time last year, 2019, you Gbenga Fajuyi, aged 47 years of Ungwan Nasarawa, in Tunga lured your biological daughter Hope Gbenga aged 17 years old an SSS1 student of Government Day Secondary School Sabon wuse, in your room and forcefully had sexually intercourse with her.

“As a result, she became pregnant and delivered a baby girl and also warned her that if she tell any body you will kill her.

“During police investigation, you Gbenga Fajuyi confessed to the offences.”

When the charges were read to him by the presiding senior Magistrate Safura Abdulkareem, he pleaded not guilty to the charges, and the police prosecutor, Inspector Mua’azu Abdullahi objected to his bail on the ground that the charges against him is not bailable.

At this point the Magistrate ordered him to be remanded in Minna new Custodial centre in Tunga and adjougned the case to 18th August, 2020 for further mentioning.
